A. GENERAL PROVISIONS
1. Application of the rules
- These rules apply in all premises and annexes, on all sports and play areas both indoors and outdoors, and in the surroundings of Centre Sportif Mounier. They apply to all persons frequenting the Centre, whether as a customer, accompanying person, simple visitor, spectator, …
- Any person frequenting the Sports Centre is presumed to have read these rules, to have accepted them, and to have undertaken to comply with each and every one of their provisions.
2. Purposes and Exclusions
- The association's purpose is the promotion of ambitious, high-quality sports practice in all its forms without discrimination and the promotion of health education through sport. To this end, the Centre draws up an annual occupancy and activities plan providing for the organisation of sports activities freely available to the whole population within the facilities listed in accordance with the decree of the Government of the French Community implementing the decree of 27 February 2003 organising the recognition and subsidisation of local sports centres and integrated local sports centres. This plan clearly distinguishes between supervised sports activities and those open to the general public outside this framework. The association's purpose is the promotion of the values of sporting ethics and fair play among the Centre's users.
- The Sports Centre's facilities are exclusively intended for the practice of sports and games such as notably tennis, squash, badminton, basketball, volleyball, indoor hockey, handball, indoor football and other sports activities, to the exclusion of all other commercial or other activities … Any person frequenting the sports premises, play and sports areas and their annexes and accessories may not put them to any use other than that for which authorisation was granted, nor divert them in any way from their purpose; they are required to occupy, to the exclusion of any other, the sports or play area allocated to them.
- Except for particular and exceptional derogations to be agreed with the Centre's management, the sale of drinks, food or sweets is exclusively reserved for the cafeterias.
3. General policing – Order – Peace – Decency – Cleanliness
- For the safety of customers, the centre is under video surveillance with recording.
- Any person present in the Sports Centre undertakes to comply with the prescriptions and instructions given to them by members of staff and accepts to show their identity card and to allow a photocopy to be taken at their first request, on pain of immediate expulsion.
- Entry to the Sports Centre is prohibited for persons whose attire is inappropriate and for individuals in a state of intoxication.
- Any person frequenting the Sports Centre is asked not to disturb the public by noise, singing, shouting, games or other …
- Any person frequenting the Sports Centre in any capacity whatsoever is asked to use the most correct language and to wear decent attire
- Any person who, through their behaviour, harms the good conduct or proper functioning of the Sports Centre, fails to comply with the regulatory prescriptions and recommendations made to them by any qualified person, or in general poses any risk whatsoever to other users of the Centre, may be expelled and access to the Sports Centre may then be denied to them either temporarily or permanently.
- Any customer who occupies play and/or sports areas in any capacity whatsoever is asked to leave the rooms and courts in the state of cleanliness and tidiness in which they found them on entering; any failure in this regard, such as leaving papers, waste, plastic bags, … shall entitle the Sports Centre to charge an amount equivalent to the cost of the staff work required to remedy the situation, without prejudice to any damages. Users of rooms or facilities are required to report to reception, before taking up the rental, any disorder or danger they may have noticed there.
- It is strictly prohibited to move around the Sports Centre and on all outdoor surfaces of the Centre with animals, whether or not they are kept on a leash.
- Sports activities, notably ball games, are not permitted in the entrance hall, in the corridors, or on the access paths to the Centre.
- It is prohibited to use the Sports Centre and car parks without the management's agreement as a meeting point for activities organised outside the Sports Centre.
- The available car parks are unsupervised. The Centre declines all responsibility in the event of theft or damage.
- The organisation of a sports activity with any sound equipment may under no circumstances cause inconvenience to other customers.
4. Sanctions
- Any person infringing the provisions of these rules shall be liable, alternatively, at the discretionary choice of the Management, to the following measures:
- Simple expulsion for a maximum period of 24 hours
- Partial, temporary or permanent ban, exclusively linked to the practice of a specific sport or game, or to the use of certain equipment,
- Simple exclusion from the Sports Centre, temporary or permanent.
- Any sanction imposed in accordance with the provisions of article 4.1 shall be notified to the authority responsible for the activity in which the sanctioned person was participating.
- Moreover, in the event that this person falls, by statute, under the authority of one of the member parties of the ASBL managing the Sports Centre, the problem shall be submitted by the Centre's Management, at the latest eight days after the incriminated facts, to the authority to which this person belongs. In the event of disagreement between the Management and the authority in question on the sanction to be applied, the dispute shall then be submitted, within one month of the facts, to the Board of the Sports Centre's Board of Directors.
- The various sanctions referred to in article 4.1 shall ipso facto entail the cancellation, to the corresponding extent, of the title (right of occupancy, rental, subscription, …) relating to the use of the play or sports area concerned, without any right to reimbursement arising on the part of the person concerned.
- Children accompanying their parents during a sports activity are under their full responsibility. Parents must provide effective supervision of their children and ensure that they do not disrupt activities, nor play in potentially dangerous places
5. Access to the Sports Centre
- Entry to the Sports Centre is exclusively via the reception hall.
- The Sports Centre and its facilities are open from 2 January to 31 December, with the exception of 25 December. Opening hours are displayed at reception. The Sports Centre and its facilities are accessible in accordance with duly granted authorisations and the occupancy timetable set by the Sports Centre. Any change to this timetable is the exclusive competence of the Sports Centre, which reserves the right to modify it on its own initiative, where necessary, without any claim for compensation or damages being possible by anyone.
- The opening hours and rates for the various play and sports areas are available from the reception attendant.
- Use of the play and sports areas imperatively requires possession of a title (rental contract, till receipt or other …) or special authorisation issued by the Management; any person frequenting the Sports Centre must carry it and show it at the first request of a member of staff.
- The keys to the rooms and changing rooms must be collected from the reception attendant against the deposit of an identity document and mention of the reservation; as changing rooms are limited, the receptionist shall alone and in the last resort judge the appropriateness of handing over or not to the customer the key to a changing room during their rental. The granting of keys for the changing rooms always depends on the general occupancy of the Sports Centre. After the activity, all room doors shall be locked and the lights shall be switched off. The keys shall be returned to reception.
- Access to technical premises is prohibited.
- The keys to the storage lockers, made available to individual customers, must be collected from the reception attendant against the deposit of an identity document (or similar document) and payment of a flat-rate rental per day.
- Storage cabinets are rented to groups (Schools, Clubs, federations …). This provision is intended for a complete season starting in September and ending in August of the following year. The rental price is determined on a flat-rate basis for the duration of the season. The request must be submitted at reception on a specific form. In the event of theft or vandalism, the Centre cannot be held responsible for missing or damaged equipment.
- As soon as a customer encounters a problem with a key entrusted to them, they are required to inform reception immediately. Any lost, damaged or lost key is invoiced to the customer at cost price. An acknowledgement of debt is signed by the customer. The invoicing includes at least the replacement of the cylinder and the supply of three new keys.
- Marking of the changing rooms is permitted on suitable supports. Temporary marking on the floor is permitted provided that the customer removes it once the rental has ended. Marking on the walls is strictly prohibited.
6. Responsibilities
- The Sports Centre, its Board of Directors, the Management, and the members of staff decline all responsibility in the event of an accident occurring, particularly in the hypothesis of a violation by the victim and/or the person(s) having custody and/or responsibility for them, of one of the provisions of these rules.
- Any person, de facto association, non-profit organisation, grouping … frequenting the Sports Centre and/or using the play and/or sports areas, is responsible for any damage caused both to persons and to the premises themselves, as well as to their outbuildings and equipment. Any damage will entail the obligation for the person who caused it to provide full compensation, without prejudice to any administrative and/or judicial sanctions that may also be taken.
- Any de facto association, club, non-profit organisation, grouping … frequenting the Sports Centre and/or using the play and/or sports areas must have its civil liability covered by an insurance policy; it undertakes to provide proof of the taking out of such insurance at the first request of the Management.
- Any person, de facto association, club, non-profit organisation, frequenting the Sports Centre and/or using the play and/or sports areas always remains personally responsible for the proper performance of its obligations towards third parties and any public or private authority or administration. This person remains bound, where applicable, to pay the taxes, duties or royalties and other possible charges arising from its activities, including the practice of sport.
- Any sports club, youth movement, youth activity group, any group whatsoever (whether constituted as a de facto association, non-profit organisation or otherwise…) frequenting the Sports Centre undertakes to provide sufficient supervision of its members by qualified persons in order to prevent any possible accident; likewise, it undertakes to take out and to have taken out by its instructors, supervisory staff and members all necessary civil liability and personal accident insurance.
- Any person frequenting the Sports Centre is advised against bringing cash and valuables there. In any event, the Sports Centre and the Management decline any responsibility whatsoever in the event of theft, loss, damage, deterioration of any kind of personal objects, clothing, cash, valuables, … or other, of equipment belonging to persons or groups frequenting the facilities or present there for any reason whatsoever, the Sports Centre assuming no duty of custody or supervision as a depositary or otherwise.
- Responsibility of users and sports practice: The hire of the pitch is granted for autonomous recreational sports practice. Users practise their sport under their own responsibility. The sports centre cannot be held responsible for bodily, material or immaterial damage occurring during sports practice, resulting in particular from clumsiness, imprudence, a lack of physical fitness or inappropriate behaviour of the players or their partners.
- Insurance obligation: Each user (hirer of the pitch and participants) is required to be covered by a personal civil liability insurance policy and, ideally, by personal accident insurance. In the event of bodily damage occurring during play without any fault or breach of the sports centre's safety obligation being demonstrated, only the personal insurance policies of the users concerned will be called upon.
- Limits of the centre's responsibility: The sports centre declines any responsibility in the event of theft or deterioration of users' personal belongings within the establishment (pitches, changing rooms). The centre's liability may only be sought in the event of gross negligence or a proven breach of its obligation of normal maintenance and safety of the facilities made available.
7. Bookings
- Bookings of sports and play areas, whether covered or outdoor, are made according to the Centre's availability:
- Short-term hires for pitches, sports and play areas, whether covered or outdoor, are agreed with the Centre's reception;
- Long-term hires for pitches, sports and play areas, whether covered or outdoor, are agreed with the Management.
- All hires are governed by the specific conditions of the hire contract and the various provisions of these rules.
- The rules setting out the general hire conditions are available on the Sports Centre's website. They specify the procedures for booking a room or a pitch, as well as the payment, cancellation or refund conditions.
- The specific conditions of the Tennis, Fitness and Padel Club Mounier are available in articles 34 and following of these rules.
8. Food – tobacco – Litter
- It is strictly forbidden to throw any waste whatsoever anywhere other than in the bins and rubbish bins intended for that purpose.
- It is forbidden to smoke, eat and consume drinks in the sports premises, on all indoor and outdoor play and sports areas, as well as in their surroundings and in the stands, all of this being authorised only in the cafeteria. Only the use of plastic water bottles is authorised.
9. Changing rooms
- Any person frequenting the Sports Centre agrees to submit to the instructions given to them by the reception attendant regarding the procedures for using the changing rooms.
- Undressing and dressing may only be carried out inside the changing rooms.
- In the event of simultaneous occupation of the same changing room by several distinct clubs or groups, their respective managers must have their members' clothing grouped together in order to facilitate the installation of other sportspeople.
- Authorisation to occupy the play and sports areas implies that of using the necessary parts of the changing rooms and showers as determined by the reception attendant, and this for the strictly indispensable time, namely a maximum of half an hour before and half an hour after the duration of the activity.
10. Respect for Schedules
- The occupants of the sports premises must take care not to disturb the activities of other persons or client groups frequenting the Sports Centre.
- To this end, they will take care to use only the play or sports area allocated to them and to begin and end their activities at the scheduled times, including the setting up and putting back of the equipment.
- They will also organise themselves to vacate the changing rooms and showers within the time limits prescribed in article 9.4 above.
- The Centre closes its doors 30 minutes after the last hire.
11. Equipment and Facilities
- The equipment and facilities with which the sports premises and the play and sports areas, both indoors and outdoors, are equipped may only be used in accordance with the usual practice and sports ethics of the sport concerned.
- All this equipment and facilities must be put away after each use, within the time slot reserved by the client and according to the storage plans displayed in the halls; any violation whatsoever of this provision will result in the immediate invoicing to the client or to the club, group or association to which they belong, of the storage work carried out by the Sports Centre's staff.
- On pain of being held personally responsible, all clients are invited to inform the reception attendant and the Management immediately of any defect or damage found in the equipment and facilities.
- All deterioration, damage, disappearance … whether voluntary or involuntary, affecting the equipment and facilities will be charged to the responsible clients and/or the clubs, groups, associations … to which they belong.
- Any specific equipment or facility necessary for the practice of a particular activity, including in particular the use of trampolines and gymnastics equipment in general, is required subject to formal and express authorisation from the Centre's Management. A specific request form is available at reception.
- Any equipment or facility belonging to the client, sports club, association or other organisation may only be used at the Centre subject to formal and express authorisation from the Centre's Management. This equipment is brought in, used and stored at the client's own risk.
- For the following disciplines: badminton, tennis, squash, basketball, volleyball and indoor football, the Sports Centre provides hire equipment (balls, shuttlecocks, rackets, …) whose lists and prices are available at reception. The client is responsible for the equipment received on hire and must take care to use it as a good householder. Any loss or any abusive deterioration is invoiced to the client.
12. Club events
- Clubs, groups and associations authorised to use the sports premises, play and sports areas both indoors and outdoors are also authorised, subject to prior notice and, where applicable, in consultation with the Management, to organise official matches or sports events and to charge an entry fee on that occasion.
- However, events of an exceptional nature will be subject to a specific case-by-case examination and may only take place subject to formal and express authorisation from the Management.
13. Events organised by the Sports Centre
- The Sports Centre reserves the right to organise any competition, event or other, even during the Centre's normal opening hours and, accordingly, also reserves the right to set the time it deems necessary for the complete or partial evacuation of the Centre and/or of one and/or the other of the play and sports areas.
- The hires corresponding to the periods of the competitions and events referred to in 13.1 will thus be terminated accordingly at the sole initiative of the Sports Centre and will give rise to a refund to the client of any price paid, to the exclusion of any damages whatsoever.
14. Notices and Advertising and the Centre's website
- Folder display stands are available to customers near reception, in the entrance hall. They are exclusively reserved for advertising activities organised at the Centre Sportif Mounier. No exceptions will be granted.
- Any other display on walls, windows, doors … is expressly subject to the prior and explicit agreement of the Management.
- The Management of the Sports Centre expressly reserves the right to remove any poster or advertisement it deems inappropriate or unsuitable.
- Any electronic link between a customer's website and the centre's website is subject to prior written authorisation from the Centre's Management.
- Sports clubs that occupy rooms or sports grounds at the Sports Centre may be included, at their request, in the promotional materials put in place by the Centre (website, social media, brochure, …).
- Taking photos, images, videos or sound recordings is permitted only with the agreement of the Management.
15. Climbing room and fitness room
- Every customer of these areas agrees to comply with the Centre's internal rules or the specific rules governing their use.
- With regard to access to the climbing room outside supervised hours, access to and use of the climbing wall require certain formalities to be completed in advance at the Sports Centre's reception. The customer must therefore provide proof of their ability to climb without supervision. This may be:
- either a membership of the Club Alpin Belge
- or an approval certificate issued by "Stone Age, Asbl", which manages the room.
- With regard to insurance, if not a member of the Club Alpin Belge, the prospective climber must provide proof of insurance for this purpose through any other broker, or failing that, pay their insurance fee directly at reception.
With regard to access to the climbing room during supervised hours, the internal rules of "Stone Age, Asbl", which manages the room, apply.
16. Safety
- Customers must comply with safety instructions, including in particular:
- The evacuation plans displayed in the rooms,
- The alerts and alarms that are triggered,
- The instructions given by the Centre's staff or by any other audio medium in order to allow a rapid evacuation of the premises.
- Organisations, groups, clubs and schools must carry out group evacuations to the designated assembly points and account for the sports participants belonging to these groups as quickly as possible.
- In the event of an accident, customers and those in charge of the various groups immediately contact reception, which calls an ambulance if this is necessary. A first-aid kit is available at reception.
- In the event of an accident requiring an ambulance, those in charge of schools, groups or organisations complete as soon as possible a document describing the circumstances of the accident. This document is available at reception.
17. Users' council
- The users' council's mission is to issue advisory opinions to the board of directors on matters of activities and the development of activity programmes for the local sports centre.
- It is composed of representatives of the users of the sports facilities that make up the local sports centre.
- Meetings of the users' council are chaired by the coordinator/manager. The users' council also elects a secretary from among its members.
- The users' council meets at least twice a year, on the convocation of the chair or at the request of one third of its members, and in particular in the first fortnight of May in order to prepare the organisation of the following sports season.
- The secretary's task is to send the minutes, recording the opinions issued by the users' council, to the association's board of directors within 7 days following the meeting.
- An AED is present in the entrance hall of the Centre. The Centre organises an annual information and training session on the use of an AED for users of the facilities.
B. SPORTS ROOMS, PLAY AND SPORTS AREAS
18. Bookings – Timetables – Use
- Before occupying any sports room, play or sports area, the customer must spontaneously present themselves at reception to pay the rental fee in advance.
- Any occupation of a sports room, play or sports area is subject to the express authorisation of the Sports Centre and to compliance with the usage timetable it has established.
The usage timetable includes the setting up and dismantling of equipment by the customer - Any extension of the usage period must be subject to prior and express approval – before the expiry of the current period – from the Management and/or the staff at reception. Any rental hour started is due.
- The sports room or play or sports area may be used only for the purposes for which it has been rented.
- Any rental or booking not confirmed by an actual presence within ten minutes at the latest after the start of the period may automatically be put back up for rental at the Management's discretion, with no possibility of discussion whatsoever, and this without giving rise to any right to a refund on the customer's part.
This provision applies both to individual rentals and group rentals.
- Except with the express agreement of the Management in exceptional circumstances, no rental will be partially reduced or even fully cancelled in relation to the number of hours booked under the rental contract.
- Any recurring rental that remains unused for at least three successive periods may be cancelled at the initiative of the Sports Centre's Management, without notice or any obligation to refund the customer, and without prejudice to the Sports Centre's right to collect all sums due under the rental contract and, at the same time, to put the periods covered by said cancellation back up for rental.
- Where it is duly established that, following a booking error by the Centre, the customer cannot benefit from their rental, they are compensated in the form of a new booking equivalent to the first, but the cost of which will be entirely borne by the Centre.
- Rates are available at the Centre's reception and can be consulted at any time on the Centre's website: mounier.be.
19. Footwear
- Wearing sports shoes is compulsory for anyone (sports participant, visitor, spectator, …) in a sports room or on a sports or play area.
It is also essential that the said shoes are clean and that they are not likely to leave any mark whatsoever on the floor coverings.
In particular, the use of sports shoes with black soles, likely to leave any marks whatsoever on the floor coverings, is strictly prohibited in all rooms. - On the tennis courts, tennis shoes (flat soles, with a herringbone pattern, without any particular tread), to the exclusion of all others, are required.
- Wearing suitable spiked shoes is compulsory for indoor athletics; only spikes similar to those sold at reception are permitted.
- Any breach of one and/or other of the requirements set out in articles 18.1. to 18.3. will result in the immediate charging of a penalty of €75.00 without prejudice to the Sports Centre's right to claim, in addition and at the expense of the offender, reimbursement of the cost of cleaning work by the Centre's staff.
20. Exclusive Occupation
- Access to sports rooms and play and sports areas is exclusively reserved for persons holding an occupation right who have complied with the requirements of article 16.1 and, where applicable, those whose presence is essential for the proper conduct of training sessions, events, competitions …
- Any person present on premises regularly rented to a customer will be presumed to have accessed them with that customer's authorisation, and the customer will assume full responsibility for this.
21. Transfer of the right of occupation
- No tenant or holder of an authorisation to occupy a sports room or play or sports area may transfer this right to anyone, except with the formal and express agreement of the Sports Centre's Management.
Breach of this provision will automatically result in termination of the rental agreement and/or revocation of the occupation authorisation, without prejudice to the Sports Centre's right to claim from the tenant and/or occupant payment of the sums due under the rental contract, which remain fully payable to the Sports Centre.
22. Timetable Changes
- Any change whatsoever to the timetable of activities of a customer, club, group, association …, whether occasional or permanent (booking, cancellation, change of day or time, …) may only be made with the formal and express agreement of the Management, and with a minimum notice period of fifteen days.
- As far as possible, the Sports Centre will endeavour to grant this timetable change request favourably, and only to the extent of its obligation not to disrupt the other activities organised at the Sports Centre.
23. Assembly, Dismantling and use
- All users of the sports facilities, play and sports areas undertake to set up, dismantle and store in the designated places the material and equipment they need, where applicable in accordance with the instructions given by the Centre Sportif staff. On the crushed brick pitches, players put away the equalising net at the end of the rental period.
These operations must imperatively take place within the time slot reserved by the customer, who undertakes not to exceed the activity end times.
- Material and equipment fitted with an anchoring system (indoor football goals, mobile basketball hoops, etc.) must imperatively be secured to the ground in all cases, whether in use or when being stored; this is a basic safety obligation governing the conduct of the activity concerned in complete safety.
24. Complaints
- If the customer notices a malfunction or is the victim of one, or if they believe they have suffered any kind of harm within the Centre, they may lodge a written complaint addressed to the management. A special form is available at reception.
- The complaint is examined by the management, which undertakes to send a written reply within 8 calendar days. At their request, the customer may ask to be heard by the management, and conversely, the customer may be invited to appear before the Centre's management.
C. OUTDOOR CLIMBING WALL
25. Access to the outdoor climbing wall
- Access to and use of the outdoor climbing wall is permitted only under the supervision of the climbing hall instructors.
- Every customer of the climbing wall acknowledges the objectively dangerous nature of this activity and formally releases the Centre Sportif from all liability in the event of an accident.
D. SPECTATORS
26. Instructions for spectators
- In Hall H 3, spectators are permitted only on the stands, which are accessible via the restaurant "Le Mounier". In Halls H1 and H2, spectators are permitted only on the stands, which are directly accessible.
Their presence is also permitted on the paved circulation areas of the outdoor sports and play pitches and areas, excluding the said areas themselves.
- Any customer, club, grouping, association, etc. or other organiser of a show, championship, sporting event or other event is responsible for any damage caused by spectators. They undertake to ensure that spectators comply with the provisions of these rules, and in particular Articles 8.1 and 8.2 above concerning the use of tobacco and refreshments. They know and accept that they must compensate the Centre Sportif for any damage caused on the occasion of and/or as a result of organising such an event.
E. SUPERVISION AND LESSONS
27. Supervision of lessons by customers
- Any holder of a duly issued authorisation to occupy, as occupant, tenant or otherwise, a sports room, play area or sports area is strictly prohibited from holding there any lessons, classes or teaching programmes of any kind, whether for payment or free of charge, and whether given by amateurs or professionals of the sporting activity concerned, without the formal and express authorisation of the Management.
- Any breach whatsoever of the provisions of Article 28 shall automatically result in the immediate withdrawal of the authorisation to occupy and/or the termination of the rental agreement, without any right to reimbursement arising on the part of the customer, and without prejudice to the Centre Sportif's right to claim compensation from the customer and from anyone else for all damages.
- Any person wishing to give or supervise lessons, classes or teaching programmes of any kind in any sporting practice within the Centre Sportif must, beforehand and on pain of immediate expulsion, obtain the formal and express agreement of the Centre Sportif's Management, in writing.
If the Management of the Centre agrees, the activity will be carried out under the exclusive civil liability of the organiser.
This agreement is granted to the person concerned only after an in-depth examination of a complete file drawn up in accordance with requirements about which all necessary information can be obtained from the Centre Sportif's commercial department.
- In the context of organising lessons, events or various exhibitions, persons working as self-employed or employed persons must ensure they comply with the laws governing the organisation of social security. Volunteers must hold a specific contract.
F. "VIVONS SPORT" SPORTS MOVEMENT CHARTER
28. The spirit of sport
- Taking part in sport is a right, a source of pleasure and play. Sportsmanship is positive. It promotes humility in victory and dignity in defeat. More than performance, sport contributes to individual fulfilment and collective emancipation.
- Mind and body are the athlete's primary tools. Sport is the basis of a healthy lifestyle. Taking part in sport acts on both physical and mental well-being. Doping falsifies the value of a victory or a participation. The use of illicit substances is harmful to health.
- The French-speaking sports movement rejects and condemns all forms of discrimination based on age, gender, race, sexual orientation, religious or philosophical beliefs, language or physical characteristics. The field is a space of expression open to all.
- All forms of harassment, derogatory gestures and words, and vulgarity are prohibited.
- An opponent is not an enemy. They are the athlete's first partner, and their human and physical integrity must be preserved.
- Taking part in sport is a partner of education in acquiring knowledge and learning to live together in society through tolerance and respect for the rules of the game.
- All forms of corruption and falsification of competition are prohibited.
- The sporting approach is a societal project that accompanies the individual throughout their life.
29. The people involved in sport
- Athletes love sport. Through regular, serious training, they take pleasure in their discipline. Respect is the athlete's foremost value towards their coach, their teammates, their opponents, the rules of the game, the referee and themselves. Athletes accept refereeing decisions without dispute.
- Parents recognise that their child plays for fun. They encourage their child to take part in a variety of sports so that they find their sport. They encourage their child, their teammates and their opponents. They recognise that the coach's role is to support their child in their sporting progress. They do not criticise the decisions of the coach and the referee in public. They take an active part in the life of their child's sports association.
- High-level athletes are ambassadors of the sports movement. Their behaviour is beyond reproach and their performances encourage participation in sport. High-level sport is encouraged as the pursuit of self-improvement and the path towards excellence.
- Sports coaches are the guarantors of their athletes' ethical behaviour and fair-play gestures. They promote their athletes' fulfilment through training and objectives suited to their age and potential. They plan their work over the long term rather than seeking short-term gains.
- The French-speaking sports movement is based on clubs. They must be managed with a sustainable objective by developing a lasting sports project.
- Referees are athletes in their own right. They are the guardians of the rules of the game. With the support of players, officials and supporters, they undertake to stop a game when remarks or gestures go against sporting ethics.
- Supporting means making every sporting fixture a time of celebration. Encouragement is their only creed. Their behaviour is beyond reproach. Supporters are ambassadors of their club and cannot tarnish its image.
- The media take part in the life of the sports movement. The terms used are positive, imbued with sportsmanship and free of animosity, avoiding the use of warlike language.
- Sport is a vehicle for integration. Through volunteering, citizens contribute to the dynamism of our society.
30. Sport's commitments
- Training is the watchword of the French-speaking sports movement. Its members undertake, at their own level, to complement their practical know-how with appropriate training in order to significantly improve sporting practice.
- Athletes have the right to practise their discipline in quality facilities and in a safe environment. Quality sports facilities encourage people to take part in sport. Deliberate damage to them or damage through lack of foresight is an attack on the sports movement.
- Regular, quality sporting practice combined with a healthy lifestyle are essential assets for improving health, preventing illness and developing social interactions in the interests of greater well-being.
- The organisation of sporting events and sporting practice incorporate the notions of sustainable development and respect for the environment.
- The FWB Ethics Committee examines any act that contravenes the spirit of sport.
- All those involved undertake to sign up to, respect, defend and promote the FWB sports movement charter, a sine qua non for obtaining the available support for the sports sector.
G. SPECIFIC CONDITIONS FOR ONLINE BOOKINGS
- One-off bookings with online payment are non-refundable and non-cancellable. Only the rescheduling of online bookings is possible under the following conditions:
- For tennis/squash/badminton/padel/studio bookings: When the customer contacts reception on 02.762.85.22 at least 48 hours before the booking takes place. A new date can then be agreed for a slot within 14 days from the cancellation date and subject to court availability.
- When the playing surface is unplayable (weather, non-functional equipment, an official competition running over, etc.). A new date can then be agreed for a slot within 14 days from the cancellation date and subject to court availability.
- When competition matches are organised and the games are in progress, they take priority. In the event of a match running over, or if the games have to be moved to other courts (weather, etc.), the customer who can no longer use their court will be informed immediately by reception and a new booking agreed for a slot within 14 days from the cancellation date and subject to court availability.
H. CONDITIONS SPECIFIC TO “FIXED DAY AND TIME TENNIS & PADEL” SUBSCRIPTIONS
31. Before the season
- Buying the subscription: After agreeing a day and time slot with the Centre’s commercial department, the customer can purchase the subscription online or at the Centre’s reception.
- Refunding the subscription: The subscription can be refunded before 1st September subject to the following cancellation fees:
Before 1st July: €0 /subscription, between 1st July and 1st August: €50 /subscription, between 1st and 31st August: €100/subscription, after 1st September: no refund.
- The subscriber is responsible for managing their bookings via their online account. Current bookings can be viewed there, along with remaining credits or validity dates. The customer can cancel or book a court (see 32. During the season).
32. During the season
- The customer can cancel a session via their online account at least 48 hours before the hire time. Cancellation within the same timeframe is also possible at the Centre’s reception (02/762.85.22);
- A session cancelled before the 48-hour deadline is credited back to the subscription as credits, allowing a new online booking to be made within 14 days and before the subscription’s expiry date for the same day/timeslot. After this deadline, any unbooked balance will be lost;
- In the event of illness/injury, no refund or extension will be granted;
- For specific reasons (works, storm, severe cold, technical problem, lesson or camp, energy saving, etc.), the subscriber may be transferred to another court of the same surface.
- On the tennis courts, tennis shoes are required (flat soles with no particular tread). Users must pass the net at the end of play. If a breach is noted, the Centre’s staff may require the players to leave the courts without any refund and they will be required to pay a €50 fine.
- Only the coaches of Mounier Tennis and Padel Club are authorised to give lessons. Any exception must be the subject of a written agreement from the Management of the sports centre.
33. After the season
- The subscriber has a priority right to renew their day/time slot/court for the following period, except in the event of a request from the co-owners of the Centre or activities organised by the Mounier Tennis or Padel School. In that case, an alternative to the slot the subscriber held will be offered to them.
I. CONDITIONS SPECIFIC TO MONTHLY OR ANNUAL PADEL MEMBERSHIPS
34. Term of commitment / direct debit / contract
- TERM OF COMMITMENT: Members commit for the term taken out. For the membership with monthly direct debit, the amount equivalent to two months must be paid on registration from the account on which the monthly direct debits are made.
- DIRECT DEBIT: The Club collects €52/94 at the start of the month, until the member gives notification of giving up their padel membership.
- CONTRACT: Each member may end the contract from the end of the minimum commitment period, by simply sending an email to padel@mounier.be. The notice period is 2 months. During this period, the club will not collect any direct debit. Price increases will be limited to a maximum of 2.3% (September) of the initial rate in force. Any increase above this threshold will require the customer’s prior agreement. In the event of this limit being exceeded or the hire conditions being changed, the customer may cancel their subscription free of charge within 30 days of the notification.
35. Bookings / cancellations / member fee / time slots
- MEMBER FEE
- Each member can start a match depending on available slots or sign up for a match offered by another member. Each participation in a match = 1 game.
- Each member can book up to 2 (go) / 4 (pro) games per week depending on the package taken out. Any additional game = €10. Registrations will be managed by the booking programme.
- Booking up to a maximum of 14 days in advance
- Cancellations can be made free of charge via the customer account at the latest 24 hours before the game. After that, the game is payable (for the person signed up to the match) as well as any games not completed (for the match organiser).
- Games may not be transferred to a third party. Playing under another person’s name is considered fraud.
- Training games with fewer than 4 players are authorised only from Monday to Friday before 17:00
- The official time for managing slots is defined by the clock provided by the MPC near the courts. Bookings must be made according to the following fixed slots: On weekdays: 08:00 / 09:30 / 11:00 / 12:30 / 14:00 / 15:30 / 17:00 / 18:30 / 20:00 / 21:30 At weekends: 9:00 / 10:30 / 12:00 / 13:30 / 15:00 / 16:30 / 18:00 / 19:30 / 21:00. After their booking, the customer may use the changing rooms within opening hours.
36. Fraud / Padel lessons / Promotional offers
- FRAUD – During a check and in the event of non-compliance, the Centre’s staff may exclude the member for the season with immediate effect. Any fraud whatsoever (presence of a non-member on the court without payment, booking for a third party, etc.) may lead to the member being excluded for the season, with no possibility of recourse to any form of refund or compensation.
- LESSONS – Only the coaches of the Mounier school are authorised to give lessons. Any member or holder of a duly authorised occupation permit as occupant, tenant or otherwise … of a court is strictly forbidden from receiving there any lessons, tuition or programmes of instruction whatsoever, whether for payment or free of charge, and whether given by amateurs or professionals of the sport concerned, without the formal and express authorisation of the Management.
- PROMOTIONAL OFFERS – Special or promotional offers are intended solely for new members of Padel Club Mounier.
J. CONDITIONS SPECIFIC TO TENNIS & PADEL LESSONS CLUB MOUNIER
37. Tennis activities
- The Mounier Tennis School (ETM) and the Mounier Padel Club (EPM), hereinafter referred to as EPTM, make available to their customers the courts, equipment, accessories, programmes and services relating to tennis lessons.
- The EPTM has public liability insurance. The EPTM’s liability applies where an accident is caused by a defect in the facilities or machines, or by a sudden and unforeseeable event during lessons. However, liability may be shared, in the sense that the Customer may also be liable for their own actions, for damage caused to themselves or to others. In particular if they do not follow the recommendations of the centre’s staff or the instructions and rules of the sport concerned.
- Lesson bookings can be made on the EPTM website. Lessons are accessible by age, level, period, day and duration. Access to tennis lessons is exclusively after booking, payment and confirmation of the lessons.
- Enrolment in lessons is final. During a lesson cycle, when the lesson is scheduled and given, a pupil’s absence does not give rise to any refund or make-up, except in the event of an injury occurring during EPTM lessons (on presentation of the accident report) or long-term incapacity (minimum 1 month, justified by medical certificate). In such a case, the incapacity must be reported within a maximum of 7 days following the (temporary) stoppage of lessons to the email address tennis@mounier.be (ETM) or padel@mounier.be (EPM). The refund will then be made up to 50% of the lessons missed from the date of the medical certificate. No make-up will be provided either for any absence attributable to the player. The Sports Centre reserves the right to choose the refund method and the amount that may be granted to the pupil. An alternative day / time (make-up or change of slot after booking) may nevertheless be agreed by mutual consent and subject to availability.
- After registering for a camp, for organisational reasons, no refund or credit note will be made except on presentation of a medical certificate at the latest 7 days before the start of the camp.
- The EPTM recommends that you consult a doctor each year before taking part in any sporting activity.
- The EPTM reserves the right to charge for damage caused to equipment or courts, whether deliberate or accidental.
K. DISPUTES
- Any dispute relating to the interpretation and/or performance of these rules will be settled by the administrative committee of Centre Sportif Mounier and, where applicable, by the competent courts of the judicial order.
