Rules and Regulations

Article 1 – Definitions

In these general terms and conditions, Le Mounier Fitness Club applies the following definitions:

The Member: the natural person (m/f), including the young person, in whose name the membership is registered.

The minimum commitment period: It is 3 months for members committing to a direct debit arrangement (Pass Liberté) and the contracted period for date-to-date subscription arrangements paid in a single payment (Pass Avantage).

The Membership Card: the card or wristband for access to the premises of Le Mounier Fitness Club.

Article 2 – General

2.1. Le Mounier Fitness Club forms an integral part of the Mounier sports centre.

2.2. All contracts concluded by Le Mounier Fitness Club are governed by Belgian law. In the event of a dispute, only the court of the place where the Establishment indicated in the membership contract is located shall have jurisdiction.

2.3. Le Mounier Fitness Club has undertaken to follow the “Fitness Sector Code of Conduct” and therefore also accepts the extrajudicial settlement of disputes as included in the Code of Conduct, if the Member wishes to invoke it.

2.4. Registration is done via a paper registration form duly completed and signed.

2.5. During opening hours, the Member may train in the club in compliance with the internal rules and regulations in force.

2.6. The Member may only access the club's facilities upon presentation of a valid membership card.

2.7. Le Mounier Fitness Club reserves the right to request proof of identity from anyone upon registration.

Article 3 – Contract

3.1. These conditions apply to all services of Le Mounier Fitness Club.

3.2. Le Mounier Fitness Club reserves the right, at the end of the minimum commitment period, to modify the rates and/or the general terms and conditions of the contract. The Member will be informed one month in advance, after which the Member has the possibility to cancel their membership free of charge provided they make the request in writing (e-mail or registered letter), during the month following the announcement made by Le Mounier Fitness Club.

Without a timely written request for cancellation, the subscription is renewed under the new conditions and for an indefinite period. It may then be cancelled according to the conditions and notice periods stated in the box on the front of the contract.

Article 4 – Membership

4.1. The membership and the payment obligation take effect on the start date as indicated by the Member upon registration.

4.2. The Member is informed that their membership takes effect for the agreed contractual duration, which takes effect from the start date of the contract.

4.3. The Member is informed that this contract is tacitly extended for an indefinite period, with the exception of date-to-date subscriptions paid in full in advance, which end by operation of law at the end of the fixed duration.

4.4 The Member subscribing to a Pass Liberté (with direct debit) is required to provide the correct bank details to Le Mounier Fitness Club.

4.5. If the participant does not use the right to train/exercise, in accordance with their registration, they may not claim any refund of the subscription fee, nor any exemption from payment of amounts due.

4.6. The single-use day pass gives single access to the club on the same day, for an unlimited duration within the opening hours. Any exit is, however, considered final.

Article 5 – Subscriptions

5.1. Subscriptions are paid in advance each month by European SEPA direct debit. In this case, Le Mounier Fitness Club collects the amount due at the beginning of the month. Le Mounier Fitness Club also offers its members the possibility to pay the entire cost for the whole membership period in a single payment. In this case, no monthly European SEPA direct debit will be required.

5.3. If a European SEPA direct debit cannot be executed, Le Mounier Fitness Club may charge an additional amount of € 5.00 for each direct debit request, corresponding to the administrative costs incurred. Le Mounier Fitness Club reserves the right to collect arrears and administrative costs by European SEPA direct debit.

5.4. In the event of non-payment on the due date and if Le Mounier Fitness Club has to resort to recovery of the debt, the non-profit organisation would be entitled to claim all sums due immediately, regardless of the payment method provided for.

Article 6 – Privacy

6.1. Le Mounier Fitness Club complies with the provisions of the Law of 8 December 1992 on the protection of privacy regarding the processing of personal data.

6.3. If the Member transmits their personal data to Le Mounier Fitness Club, it will be recorded in the database of Le Mounier Fitness Club and processed for the purposes of managing the customer file, the products and services offered, conducting market studies, informing the Member of the existence of new products and services, as well as in the context of implementing promotional and information campaigns. The personal data will not be transmitted to third parties, with the exception of affiliated companies involved in the performance of the membership contract. The member agrees that photos and videos taken in the context of Le Mounier Fitness Club's activities may be posted on the social networks of Le Mounier Fitness Club and the Mounier sports centre as well as on their respective websites.

Article 7 – Membership Card

7.1. After registration, the Member receives a Membership card. This card remains the property of Le Mounier Fitness Club and must be returned in the event of cancellation of the membership contract.

7.2. The member remains at all times responsible for the use and/or misuse of the membership card.

7.3. The loss or theft of the membership card must be reported directly to Le Mounier Fitness Club, and it will be obliged to charge the sum of €20 for

the issuance of a new membership card.

7.4. Any member at the end of their subscription (Pass Liberté or Avantage) is required to return their card no later than the last day of their subscription. Failing this, the sum of €20 will be debited from this member's SEPA account to compensate for the non-return of the card.

Article 8 – Cancellation of membership and suspension for a fixed period

8.1. The member holding a Pass Liberté (direct debit) may cancel their subscription at any time after the minimum commitment period. The cancellation request must be made in writing, i.e. by registered letter or by e-mail addressed to Centre sportif Mounier Service Fitness 87, avenue Emmanuel Mounier 1200 BRUSSELS or fitness@mounier.be.

To be valid and to avoid any debit the following month, the cancellation request must be made before the 25th of each month. Upon receipt, Le Mounier Fitness Club will suspend the monthly direct debit and the member may access the Fitness room until the end of their subscription. No refund will be made for members committing by direct debit.

8.2. The member holding a Pass Avantage (contractual period paid in full in advance) may not cancel their subscription except in the case of a situation as indicated in article 8.3. and 8.4. This notice period begins on the first day of the month following receipt of the required proof.

8.3. The Member has the possibility to suspend, for a fixed period, all types of subscription for medical reasons during the minimum commitment period, according to the conditions defined below: the temporary suspension of the subscription may only take effect after receipt of a medical certificate by e-mail or by post to Centre sportif Mounier Service Fitness 87, avenue Emmanuel Mounier 1200 BRUSSELS or fitness@mounier.be – the medical certificate must indicate the date it was sent. The suspension will take effect from receipt of the temporary suspension request to which the medical certificate is attached and until the end date of the incapacity as indicated on the medical certificate. It cannot be retroactive.

8.4 If the Member transmits a medical certificate indicating that they can no longer do sport (over a period of at least one year), Le Mounier Fitness Club may cancel the subscription at the express request of the Member. This cancellation will take effect from receipt of the express request by e-mail or by post to Centre sportif Mounier Service Fitness 87, avenue Emmanuel Mounier 1200 BRUSSELS or fitness@mounier.be to which the member must attach the valid medical certificate.

8.5. Any other method of cancellation than those mentioned in article 8.1, 8.2, 8.3 and 8.4 on the part of the Member, such as a unilateral cessation of monthly payments, is considered an abusive and unlawful breach of contract. In this case, all membership costs remain due.

8.6. Le Mounier Fitness Club may terminate the membership contract to the detriment of the Member, without giving any right to any form of damages or interest, if the Member does not comply with the internal rules, but also if, under these general terms and conditions, the Member's access to the club is refused or if this right is withdrawn from them.

Article 9 – Opening hours

9.1. Opening hours and class schedules may under no circumstances be invoked as absolute conditions of signing a contract. Le Mounier Fitness Club reserves the right to temporarily or permanently modify the club's opening hours (or those of certain parts of it). At the time of signing the contract, the group class schedules and opening hours are indicative and subject to change. Le Mounier Fitness Club reserves the right to unilaterally modify dates and opening hours. The Member may not invoke these changes to cancel their subscription, in particular because the main purpose of the business is to make available to its Members a fitness space and training equipment.

9.2. Le Mounier Fitness Club is authorised to briefly close the club for repairs and maintenance work.

Article 10 – Personal data

10.1. Changes concerning the member's personal situation (for example, address or bank details) must be communicated directly to Le Mounier Fitness Club by e-mail at fitness@mounier.be.

Article 11 – Liability

11.1. Every member is personally responsible for personal accidents and their personal belongings.

11.2. Le Mounier Fitness Club declines all liability towards its members or any third party, with the exception of (i) its possible liability towards its members in the event of intent or gross negligence on the part of Le Mounier Fitness Club or its agent; and (ii) its possible liability in the event of death or bodily injury of its members due to an act or negligence of Le Mounier Fitness Club.

11.3. Neither the company nor its staff may be held liable in the event of loss, damage or theft of personal belongings within the club's premises.

Article 12 – Internal rules and regulations of Le Mounier Fitness Club

12.1. The member is informed that Le Mounier Fitness Club has established internal rules and regulations. These internal rules and regulations may be consulted at the club's counter if necessary.

12.2. An employee of Le Mounier Fitness Club may at any time refuse access to persons whose behaviour justifies such a measure.

12.3. Le Mounier Fitness Club reserves the right to recover the membership card for reasons it deems valid and to cancel a membership directly without any refund of payment and without waiving the payment obligation for the current year.

Article 13 – Final provisions

13.1. Agreements between the Member and Le Mounier Fitness Club may only be concluded in writing, and may only be amended in writing, subject to the exceptions set out in this contract.

13.2. If any of the preceding provisions is invalidated or proves to be unlawful, the other provisions remain applicable. For registrations online or by telephone, any person is authorised to inform Le Mounier Fitness Club that they waive their registration, without financial penalty and without having to provide any reason, within 14 working days following the registration.
